Ontario Auto Insurance 5 years Review

Purpose of the review    Section 289 of the Insurance Act requires the Superintendent of the Financial Services Commission of Ontario (FSCO) to undertake every three years a review of Part VI of the Insurance Act (Automobile Insurance) and related regulations. In 2013, the government consolidated existing statutory auto insurance reviews and increased the frequency of a major review to every three years to better respond to the rapidly evolving auto insurance landscape in Ontario. FSCO is initiating a review of the auto insurance system to meet this requirement.    Part VI of the Insurance Act includes provisions that deal with approval of forms, motor vehicle liability policies, statutory conditions, direct compensation for property damage, court proceedings, and dispute resolution. Some of the regulations under Part VI include the Statutory Accident Benefits Schedule (SABS), uninsured automobile coverage, fault determination rules, disputes between insurers, court proceedings and coverages and categories of automobile insurance and risk classification systems.    Major reforms in 2010 brought about changes to increase consumer choice and stabilize auto insurance rates. From 2011 to 2013 additional changes were made to address fraud. As part of the government’s 2013 cost and rate reduction strategy, there are a number of separate initiatives currently reviewing various aspects of Ontario’s auto insurance system. These include an independent review of the auto insurance dispute resolution system, ongoing work by medical and scientific experts to develop an evidence-based treatment protocol for minor injuries, and a transparency and accountability report by outside experts.    The Superintendent’s report on this review is expected to be submitted to the Minister of Finance in or about the Fall of 2014.    Written Submissions   Consumers and stakeholders are invited to provide comments and suggestions on how to ensure a stable, sustainable and competitive auto insurance system, including: 

    reducing claim costs
    decreasing regulatory, product and administrative complexity for industry, service providers and consumers
    promoting greater consumer choice and protection
    increasing transparency in communications between insurers, service providers, policyholders and claimants
    improving the availability of auto insurance for individuals and businesses
    basing treatment of motor vehicle accident injuries on scientific and medical evidence, and
    considering approaches used in other jurisdictions

   Submissions, materials and comments received may be posted on FSCO’s website or incorporated into the Superintendent’s report to the Minister of Finance. Collection, use and disclosure of submitted information are governed by the Freedom of Information and Protection of Privacy Act.

The Superintendent of Financial Services is responsible for carrying out a review of Part VI of the Insurance Act (the Act) dealing with automobile insurance.


Part VI of the Act includes provisions that deal with the approval of forms, motor vehicle liability policies, statutory conditions, direct compensation, limitations on accident insurance, court proceedings, and dispute resolution. Some of the regulations under Part VI include: the Statutory Accident Benefits Schedule (SABS), uninsured automobile coverage, fault determination rules, disputes between insurers, and court proceedings.


The first review has been completed and the Report on the Five Year Review of Automobile Insurance has been delivered to the Minister of Finance.
